Terms of Service

1. Acceptance of Terms

By accessing or using the MLO Calculators Suite web application and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MLO Calculators Suite ("we," "us," or "our").

2. Description of Service

MLO Calculators Suite provides mortgage and loan calculation tools, client presentation generators, and related financial analysis features designed for licensed loan officers and mortgage professionals. The Service is provided on a subscription basis and may be updated, modified, or discontinued at our discretion.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements. The Service is intended for use by licensed mortgage professionals within the United States.

4. Account Registration and Security

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized access or use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. Subscription and Payments

Subscription Plans

Access to the Service requires an active paid subscription. We offer monthly and annual subscription plans. Pricing is displayed on our website and may be updated from time to time with reasonable notice.

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to the Service will continue until the end of your current billing period. No refunds will be issued for partial billing periods. We do not provide prorated refunds for unused time.

Failed Payments

If a payment fails, we may suspend your access to the Service until the payment issue is resolved. We will make reasonable efforts to notify you of any payment issues.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Provide false, misleading, or deceptive loan information to clients
• Transmit any malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, harvest, or collect data from the Service through automated means
• Resell, sublicense, or distribute the Service without our written consent
• Use the Service for any purpose other than legitimate mortgage and lending business activities

7. Intellectual Property

The Service, including its design, features, content, logos, and underlying technology, is owned by MLO Calculators Suite and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes during your active subscription.

You retain ownership of any content you create or upload to the Service (such as your branding materials, client data, and saved calculations). By using the Service, you grant us a limited license to process and display this content solely for the purpose of providing the Service to you.

8. Shared Presentations

When you generate a shareable presentation link, the content of that presentation (including calculator results, your branding, and any client-facing information) becomes accessible to anyone with the link. You are solely responsible for:

• The accuracy of the financial information presented
• Ensuring the presentation complies with all applicable lending regulations and disclosure requirements
• Obtaining any necessary consent from clients before sharing their information
• Managing who has access to the presentation links you create

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy, completeness, or reliability of any calculations, estimates, or results generated by the Service. All calculations are for informational and illustrative purposes only and should not be construed as financial advice, loan commitments, or binding offers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MLO CALCULATORS SUITE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless MLO Calculators Suite and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any content or data you submit, share, or transmit through the Service
• Any claim that your use of the Service caused damage to a third party

12. Regulatory Compliance

The Service is a tool to assist licensed mortgage professionals. You are solely responsible for ensuring that your use of the Service, including any presentations or calculations shared with clients, complies with all applicable federal, state, and local laws and regulations, including but not limited to:

• Truth in Lending Act (TILA)
• Real Estate Settlement Procedures Act (RESPA)
• Equal Credit Opportunity Act (ECOA)
• Fair Housing Act
• State-specific lending and advertising regulations

The Service does not provide legal, tax, or financial advice. Calculations and presentations are estimates and illustrations only. You should always verify results independently before making lending decisions or presenting information to clients.

13. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account data after a reasonable retention period
• Shared presentation links may cease to function
• All provisions of these Terms that should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, conducted in the State of Texas. You agree to waive any right to a jury trial or to participate in a class action.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MLO Calculators Suite regarding the use of the Service. These Terms supersede all prior agreements, understandings, and negotiations, whether written or oral, regarding the Service.
